These Terms and Conditions (“Terms”) govern access to and use of our Website and all digital products and services offered by The Resistance DayZ (“we,” “us,” or “our”). By using the Website or purchasing digital services, you agree to be bound by these Terms. If you do not accept them, you must stop using the site immediately.

1. Applicable Law & Jurisdiction

These Terms are governed exclusively by:

• the laws of the Czech Republic, including the Czech Civil Code (Občanský zákoník)
• applicable European Union legislation, including GDPR and the Digital Content Directive

Any disputes shall be resolved before Czech courts, with jurisdiction according to Czech procedural law.

2. Website Use & Acceptance

By accessing the Website, you confirm that:

• you are at least 18 years old;
• you agree to comply with these Terms;
• you will not use the Website for illegal or harmful activities.
• These Terms apply to all visitors, users, and purchasers.

8. SHOP & DIGITAL PRODUCT PURCHASE TERMS

8.1 Immediate Delivery & Waiver of Withdrawal Rights (EU Law)

Digital products are delivered immediately or within the stated time frame (5-48 hours depending on product type).

Under EU Consumer Rights Directive 2011/83/EU and Czech Civil Code § 1837 letter l, you acknowledge and agree that:

• by purchasing a digital product, you explicitly request immediate delivery,
• you waive your statutory 14-day withdrawal (refund) right,
• all purchases are final and non-refundable, except when:
  – the product was not delivered,
  – the product is defective,
  – or an error occurred on our side.

You must confirm this waiver before completing any purchase.

This applies to all digital items, including: VIP, skins, flags, armbands, knives, customizing services, clantags, bundles, and other digital assets.

8.2 Pricing & Taxes

Prices are listed in EUR or CZK depending on the selected region and may include VAT where applicable. Prices may change at any time without notice. Discounts or promotions are not applied retroactively.

8.3 Permanent Server Shutdown / Service Disruptions

In the event of a permanent server shutdown:

• no refunds or compensation will be issued for remaining time or purchased digital items.

Temporary outages, maintenance, or DayZ updates do not entitle users to compensation.

8.4 Dispute Resolution (ADR) – Czech Republic

If a disagreement arises, customers should contact us first. If unresolved, consumers may file a complaint with:

8.5 Product-Specific Terms

8.5.1 VIP Packages

• Available in 1-month and 3-month durations
• Activated automatically within ~5 minutes
• Requires correct Steam ID and Discord ID
• Works across all The Resistance DayZ servers
• Benefits include priority queue, Discord VIP features, depending on package
• VIP cannot be transferred or shared
• Expired VIP immediately loses all benefits

8.5.2 Skin Bundles

• Activated within ~5 minutes
• May require a server restart
• Non-transferable and non-exchangeable

8.5.3 Nation & State Flags

• Delivered automatically
• Requires a restart to apply
• Cosmetic only

8.5.4 Nation & State Armbands

• Delivered automatically
• Can be assigned to up to 6 additional players
• Automatically spawns on login

8.5.5 Bayonets & Karambits

• Delivered automatically
• Automatic spawn item
• Non-exchangeable after purchase

8.5.6 Custom Clantags

• Allows custom RGB clantag
• Includes one recolor per wipe
• Inactive groups (14 days) may be removed

8.5.7 Custom Skins

• Must be approved before purchase
• Delivered within 24 hours
• Non-refundable
• Can be shared with up to 6 users; extra slots available for a fee

8.5.8 Custom Flags / Armbands / Knives / Karambits / Shirts

• Buyer provides design of required resolution
• Delivery within 24-48 hours
• Must follow our design rules
• Non-refundable
• Some items allow sharing with up to 6 players

8.6 Chargebacks & Fraud

• Any unauthorized chargeback or fraudulent payment dispute will result in:
• immediate removal of all purchased items,
• permanent ban from all services,
• reporting to payment processors and fraud databases.

8.7 Technical Limitations

We are not responsible for:

• DayZ game updates affecting product performance,
• third-party bugs,
• mod conflicts,
• server-side technical issues outside our control.

These circumstances do not entitle users to refunds.

8.8 Misuse of Shared Products

If a user shares a digital product beyond the allowed limit, we may:

• revoke access to the product,
• deny future purchases,
• ban the user if warranted.

No refund is provided in such cases.

8.9 Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control, including:
natural disasters, cyberattacks, outages, government restrictions, or other unforeseeable circumstances.

8.10 Modification of Digital Products

We may modify skins, VIP benefits, or digital items as required by DayZ updates or technical needs.
Such changes do not entitle users to compensation.

8.11 No Warranties

All products are provided “as is,” without warranties regarding performance, compatibility, or specific outcomes.

8.12 Player Conduct & Ban Rules

By playing on our servers, you agree to follow all server rules.

We may suspend or permanently ban players who violate rules, cheat, harass others, or harm the community.

Bans are not refundable, and purchased digital products are not compensated. Ban evasion by alt accounts is strictly prohibited.

9. Changes to Terms

We may update or modify these Terms at any time. Changes take effect immediately upon publication on the Website.
